2. Acceptance of these terms
By browsing this website, requesting a quotation, booking a call or ordering leads or appointments, you accept these terms. If you do not accept them, please do not use the website or our services.
Where we sign a separate service agreement, proposal or order form with you, that document prevails over these terms for anything it covers. These terms govern everything it does not.
3. Definitions
- Campaign: the advertising we design, fund and run on platforms such as Google, Meta and TikTok to generate patient enquiries for you.
- Enquiry: any person who submits their details through one of our campaigns.
- Qualified Lead: an enquiry that has passed our qualification process and meets the criteria agreed with you in writing, as described in section 6.
- Booked Appointment: a qualified lead that has accepted a specific appointment slot in your calendar.
- Deliverable: a qualified lead or a booked appointment delivered to you, depending on the option you choose.
- Order: the volume, specialty, price and period agreed between us, in writing, including by email or WhatsApp.
4. Our services
We provide patient acquisition services for private clinics. In practice, we:
- design and produce advertising creative, landing pages and qualification flows;
- fund and run the advertising from our own advertising accounts and at our own expense;
- qualify enquiries, including by messaging on WhatsApp, against the criteria agreed with you;
- deliver qualified leads or booked appointments to you, by WhatsApp, email or into your CRM;
- report on volume and quality, and adjust the campaigns with your feedback.
We are a marketing company. We do not provide medical advice, we do not diagnose, we do not recommend treatments and we do not take part in any clinical decision. Every clinical assessment, consultation, quotation and treatment decision is yours, performed by your licensed professionals under your own responsibility.
We may describe your services in advertising only on the basis of the information and the approvals you give us.
5. Orders, prices and payment
- Prices are fixed per qualified lead or per booked appointment, agreed in writing before any campaign goes live.
- Prices depend on the specialty, the treatment, the market and the volume ordered. They are quoted in AED unless stated otherwise.
- We fund the advertising. You never receive an advertising invoice from a platform for campaigns we run, and you do not pay a separate media budget.
- Unless agreed otherwise in writing, invoices are issued for the deliverables of the period and are payable within fourteen (14) days of the invoice date.
- Late payment entitles us to suspend delivery and the campaigns after written notice, without compensation, until the account is settled.
- Prices are exclusive of VAT and of any other tax or duty, which are added where applicable under UAE law.
- Bank charges and currency conversion costs are borne by the payer.
Ordering more volume, pausing or stopping is done in writing. Deliverables already generated or in progress at the time of a pause remain payable.
6. Qualification and delivery
Before a campaign goes live, we agree the qualification criteria with you in writing. These typically cover the treatment requested, the timing, a budget band, the language and, where relevant, residency.
A lead is delivered as qualified when:
- the contact details have been verified, including verification of the number on WhatsApp;
- the person has expressed genuine interest in the treatment in a conversation, not merely clicked an advertisement;
- the enquiry matches the criteria agreed with you;
- the enquiry is not a duplicate of a lead already delivered to you.
Delivery is made in real time to the channel agreed with you. You are responsible for monitoring that channel and for contacting the patient. Speed to contact is the single biggest factor in conversion, and it is under your control, not ours.
7. Exclusivity
Every lead generated by your campaign is delivered to you alone and is never resold or shared with another clinic. Exclusivity applies to the leads produced by your campaigns, for the specialty and the area covered by your order. It is not a general exclusivity over a specialty, an area or a market, and it does not prevent us from working with other clinics, including in the same specialty or the same Emirate, unless we expressly agree otherwise in writing.
8. Replacement of invalid leads
We replace, free of charge, any lead that is:
- unreachable because the number is wrong or does not exist;
- a duplicate of a lead already delivered to you;
- without any genuine intent regarding the treatment;
- outside the qualification criteria agreed in writing.
Invalid leads must be reported to us within seven (7) days of delivery, with the reason. After that period the lead is considered accepted. Replacement is the sole remedy for an invalid lead: it does not give rise to a refund, a discount or compensation.
A lead that simply does not answer the phone, does not book, or does not accept the treatment is not an invalid lead.
9. No guarantee of results
We commit to the volume and the quality criteria agreed with you. We do not and cannot guarantee any commercial result: number of consultations attended, treatments accepted, revenue, return on investment or patient behaviour. These depend on your offer, your prices, your team, your speed to contact and factors outside our control.
Any figure, range, conversion rate, benchmark or simulation shown on this website, including the revenue simulator, is illustrative only. It is based on observations made on comparable campaigns, it is not a forecast, and it is not a contractual commitment.
10. Your obligations
You undertake to:
- hold, and keep valid, every licence, permit and registration required to offer and advertise your services, in particular the authorisations of the competent health authority (DHA, DoH, MOHAP or the authority of your Emirate);
- obtain the marketing and advertising permits required for the treatments promoted, and tell us without delay of any change, restriction or withdrawal;
- review and approve the advertising creative, the landing pages and the qualification scripts before they go live, and ensure they match your actual services and your permits;
- give us accurate, complete and lawful information about your services, prices, practitioners and availability;
- contact the leads delivered promptly, and handle them with your own licensed staff;
- comply with all laws applicable to the handling of patient information, medical records and consent;
- not use the leads delivered for any purpose other than offering your own services, and in particular never resell or transfer them.
Clinical claims, before-and-after content, testimonials and any statement about outcomes must come from you and comply with the rules of your health authority. We will not publish claims you have not approved, and we may refuse to run content we consider non-compliant.
11. Advertising platforms
Campaigns are subject to the policies of third-party platforms such as Google, Meta and TikTok, including their rules on health, medical and personal-attribute advertising. Those platforms may reject creative, restrict reach, suspend an account or change their policies at any time, at their sole discretion. Such decisions are outside our control. We will adapt the campaigns, but a rejection, restriction or suspension does not constitute a breach by us and does not give rise to compensation.
12. Intellectual property
The website, its content, structure, graphics, texts and software, as well as the advertising creative, funnels, qualification scripts, workflows and tools we develop, remain our exclusive property, together with the advertising accounts and assets we fund and operate. Nothing in these terms transfers them to you.
You grant us, for the duration of the services, a non-exclusive licence to use your name, logo, brand elements, photographs and content for the sole purpose of producing and running your campaigns.
Unless you object in writing, we may mention your clinic as a client and show anonymised, non-identifying performance information in our own commercial materials. We will never publish patient data.
13. Privacy and personal data
We process personal data in accordance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data, and with any other law applicable to the markets we advertise in.
Data we collect. From patients: the identification and contact details they provide through our campaigns, the answers to the qualification questions (treatment of interest, timing, budget band, language, residency) and the record of the qualification conversation. From clinics and visitors: the details you give us when you contact us or book a call.
Why we process it. To qualify enquiries and deliver them to the clinic the person asked to be contacted by, to operate and improve the campaigns, to invoice, and to meet our legal obligations.
Roles. Up to delivery, we determine how enquiry data is processed. Once a lead is delivered, you become responsible for it as an independent controller: for its security, its retention, the responses to the persons concerned, and for any medical record you then create. Each party answers for its own processing.
Health data. We collect only what is needed to route an enquiry: the treatment a person is interested in and their practical circumstances. We do not collect, request or store clinical records, diagnoses or medical histories. Patient health information you create belongs to your systems, and you remain responsible for complying with the laws that govern health data in the UAE, including the rules on where such data may be stored and transferred.
Sharing. Data is shared with the clinic the person asked to be contacted by, and with the service providers that make the service work, including advertising and messaging platforms, hosting and scheduling providers. We never sell personal data.
Retention. Enquiry data is kept only as long as needed for the purposes above and for the periods required by law, then deleted or anonymised.
Your rights. Persons concerned may request access, correction, deletion, restriction or portability of their data, and may object to certain processing or withdraw consent. Requests reach us through the contact details in section 24. If the request concerns data already delivered to a clinic, we forward it to that clinic.
15. Confidentiality
Each party keeps confidential the non-public information received from the other, including prices, performance figures, methods, scripts and patient information, and uses it only for the purpose of the services. This obligation survives the end of the relationship for three (3) years, and without limit of time for personal data and for information protected by law.
16. Warranties and disclaimers
We perform our services with professional care and in accordance with good industry practice.
Beyond that, and to the fullest extent permitted by law, the website and the services are provided without any other warranty, express or implied. We do not warrant that the website will be available without interruption or free of error, nor that the information published on it is exhaustive or up to date at all times.
17. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, including loss of profit, loss of revenue, loss of opportunity, loss of patients, loss of data or reputational harm.
Our total liability, for all claims taken together arising out of the services, is limited to the amounts you actually paid us for the services during the three (3) months preceding the event giving rise to the claim.
Nothing in these terms excludes liability that cannot be excluded under UAE law, including in case of fraud or wilful misconduct.
18. Indemnity
You indemnify us against any claim, penalty, loss or expense arising from your services, your clinical practice, the information or approvals you provide, your handling of the leads delivered, or your failure to hold the licences, permits and authorisations required for the treatments advertised.
19. Duration, suspension and termination
There is no long lock-in. Unless agreed otherwise in writing, either party may end the relationship by giving fifteen (15) days written notice.
We may suspend or terminate immediately, without compensation, where payment is overdue, where a legal or platform requirement demands it, where the information or approvals you provided prove inaccurate, or where you no longer hold the authorisations required to advertise the treatments concerned.
On termination, deliverables already generated remain payable, campaigns are stopped, and each party returns or deletes the other party confidential information, except where it must be kept by law.
20. Force majeure
Neither party is liable for a failure caused by an event beyond its reasonable control, including natural events, war, civil unrest, public authority decisions, failures of telecommunications, hosting or electricity networks, and decisions by advertising platforms that make the service impossible.
21. Changes to these terms
We may update these terms to reflect changes in our services, in platform rules or in the law. The version published on this page is the version in force, and the date below indicates its last update. Material changes affecting an ongoing order are notified to you in writing.
22. Governing law and jurisdiction
These terms are governed by the laws of the United Arab Emirates, as applied in the Emirate of Dubai, together with the regulations applicable to companies established in the free zone named in section 1.
The parties will first try to resolve any dispute amicably. Failing agreement within thirty (30) days, the dispute falls under the exclusive jurisdiction of the competent courts of Dubai, unless the parties have agreed in writing to refer it to arbitration.
23. Miscellaneous
- If a provision of these terms is held invalid, the remaining provisions stay in force.
- Our failure to enforce a provision at a given moment is not a waiver of that provision.
- You may not assign your rights or obligations without our prior written consent.
- Written communication includes email and WhatsApp messages exchanged between the parties.
- These terms are published in English. Any translation is provided for convenience only.
